Accused Alabama Teabagger is being sued by his alleged victim.

Brian Downing, the Alabama fan accused of teabgging an unconscious LSU fan in a New Orleans Krystal in a viral video after the BCS championship game is being sued by his accuser.

The LSU fan filed a lawsuit Friday against Brian Downing of Smiths Station, Ala. Downing's lawyer declined comment Friday night, saying he hadn't had a chance to read the lawsuit because neither he nor his client had been served.

Downing, 32, was booked on charges of sexual battery and obscenity but the New Orleans district attorney has until June 20 to decide whether to prosecute.

The alleged victim claims he had to "withdraw from school" because of the incident, and claims to have suffered "mental anguish, humiliation, embarrassment, anxiety and depression" and "damage to reputation" due to the incident. The amount of money sought in the lawsuit is unknown.
